Terms of Use
The EPMA Web Application (the “Platform”)
These Terms of Use (the “Terms”) are a legal agreement between you (“you” or “User”) and Ethiopia Performance Monitoring for Action(“EPMA”, “we”, “us”, or “our”) and govern your access to and use of the EPMA web application (the “Platform”), including all news and updates, publications, the data-access portal, data-visualization tools, datasets, and related content and services (collectively, the “Services”).
PLEASE READ THESE TERMS CAREFULLY. By accessing or using the Platform, creating an account, or requesting or using EPMA data, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not access or use the Platform.
1.Definitions
- “Content” means all news, updates, publications, datasets, visualizations, text, graphics, and other materials made available through the Platform.
- “EPMA Data” means datasets and data resources made available through the data-access portal and visualization tools.
- “Account” means the registered user account required to request and access EPMA Data.
2.Eligibility and User Accounts
Certain features, including requesting access to EPMA Data, require you to register for an Account. You agree to provide accurate, current, and complete information when registering and to keep it up to date. You must be legally capable of entering into a binding agreement to create an Account.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. You agree to notify us promptly of any unauthorized use of your Account. You may not share your Account, transfer it to another person, or maintain more than one Account without our permission.
3.Data-Access Requests and Approval
Access to EPMA Data is granted at EPMA’s discretion. When you submit a data-access request, you agree to provide accurate information about your identity, affiliation, and the intended purpose and use of the data. EPMA may approve, deny, condition, suspend, or revoke access to any dataset at any time, including where a request is incomplete, where the intended use is inconsistent with these Terms, or where continued access would be unlawful or inappropriate.
Access granted to you is personal and non-transferable. You may not enable or facilitate access to EPMA Data by any person who has not been granted access under these Terms.
4.Permitted Use of EPMA Data and Publications
Subject to these Terms, and unless a specific dataset or publication states otherwise, EPMA grants you a non-exclusive, non-transferable, revocable license to access, view, download, and use EPMA Data and publications for non-commercial purposes only — such as research, education, policy analysis, journalism, and public information — provided that you properly attribute EPMA as the source in accordance with Section 5.
“Non-commercial” means use that is not primarily intended for or directed toward commercial advantage or monetary compensation. If you wish to use EPMA Data or publications for any commercial purpose, or in any manner beyond the scope of this license, you must obtain EPMA’s prior written permission by contacting us using the details in Section 17.
This license framework is consistent with a Creative Commons Attribution-NonCommercial (CC BY-NC) approach. Where an individual dataset or publication carries its own license or terms, those specific terms govern that item.
5.Attribution and Citation Requirements
Whenever you use, reproduce, publish, present, or redistribute EPMA Data or publications (in whole or in part, including in derived analyses and visualizations), you must clearly and prominently acknowledge EPMA as the source. At a minimum, your attribution must identify EPMA as the source, the title of the dataset or publication, and the date or version accessed.
You must not remove, obscure, or alter any attribution, copyright, or proprietary notices contained in the Content, and you must not misrepresent EPMA as endorsing you or your work.
6.Prohibited Uses
You agree not to, and not to permit others to:
- Use the Platform or Content for any unlawful purpose or in violation of these Terms or applicable law.
- Use EPMA Data or publications for commercial purposes without EPMA’s prior written permission.
- Attempt to re-identify individuals from any anonymized or aggregated data, or use the data in any way that harms or discriminates against individuals or groups.
- Misrepresent, distort, or selectively present EPMA Data in a misleading way, or present derived results as official EPMA figures.
- Scrape, harvest, or use automated means to extract data beyond the access we provide, or place an unreasonable load on the Platform or its APIs.
- Circumvent, disable, or interfere with security, authentication, or access-control features of the Platform.
- Introduce malware, attempt to gain unauthorized access to any system, or disrupt the integrity or performance of the Platform.
- Resell, sublicense, or commercially exploit access to EPMA Data or the Platform.
7.Intellectual Property
The Platform and its Content, including all datasets, publications, visualizations, software, text, and design, are owned by EPMA or its licensors and are protected by intellectual-property and other laws. Except for the limited license granted in Section 4, no rights are transferred to you. “EPMA”, the EPMA name, and any associated logos are the property of EPMA and may not be used without prior written permission.
8.Accuracy and No Warranty
EPMA strives to provide accurate and up-to-date information. However, the Platform and all Content, including EPMA Data, publications, and visualizations, are provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, or non-infringement.
EPMA does not warrant that the Content is error-free, complete, or current, or that the Platform will be uninterrupted or secure. Any reliance you place on the Content is at your own risk, and you are responsible for independently verifying information before relying on it for decisions.
9.Limitation of Liability
To the maximum extent permitted by applicable law, EPMA and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your access to or use of (or inability to use) the Platform or Content, even if advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
10.Indemnification
You agree to indemnify and hold harmless EPMA and its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Platform or Content, your violation of these Terms, or your infringement of any rights of a third party.
11.Third-Party Content and Links
The Platform may include content from, or links to, third parties. EPMA does not control and is not responsible for third-party content, websites, or services, and their inclusion does not imply endorsement. Your use of third-party content or services is at your own risk and may be subject to their own terms.
12.Suspension and Termination
We may suspend or terminate your Account or your access to all or part of the Platform at any time, with or without notice, if we believe you have violated these Terms, if required by law, or to protect the Platform, EPMA Data, or other users. You may stop using the Platform and request deletion of your Account at any time. Sections that by their nature should survive termination — including intellectual property, attribution, disclaimers, limitation of liability, and indemnification — will survive.
13.Changes to the Platform and These Terms
We may modify, suspend, or discontinue any part of the Platform at any time. We may also update these Terms from time to time. When we do, we will post the updated Terms and revise the “Last updated” date. Where required by law, we will provide notice of material changes. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
14.Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Federal Democratic Republic of Ethiopia, without regard to conflict-of-laws principles. You agree that the courts of Addis Ababa, Ethiopia will have jurisdiction over any dispute arising out of or relating to these Terms or the Platform, subject to any mandatory rights you may have under the laws of your country of residence.
15.Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect and process personal data. By using the Platform, you acknowledge that you have read the Privacy Policy.
16.General
- Entire agreement: these Terms and the Privacy Policy constitute the entire agreement between you and EPMA regarding the Platform.
- Severability: if any provision is held invalid, the remaining provisions remain in full effect.
- No waiver: our failure to enforce any provision is not a waiver of it.
- Assignment: you may not assign these Terms without our consent; we may assign them in connection with a transfer of EPMA functions.
